General terms and conditions of use of the site www.luxaround.shop

1. Definitions
For the purposes of these general conditions, the following definitions shall apply:

• Site : the website www.luxaround.shop ;
• User : any person who accesses and navigates the Site;
• Consumer User : the adult natural person who acts for purposes outside of his/her entrepreneurial, commercial, artisanal or professional activity;
• Products : material goods sold through the Site, mainly second-hand bags;
• Conditions : this document which regulates access, use of the Site and the sale of the Products by the Owner.
  

2. Scope of application
Access to and use of the Site implies acceptance of these Conditions by the User. Anyone who does not intend to accept them is invited not to use the Site. The Conditions may be modified at any time, with effect from the date of publication on the Site. The applicable Conditions are those in force on the date of transmission of the order.

3. Object of the Site and characteristics of the Products
The Site allows the purchase of second-hand bags and the sale of the same by Users. The Products are described on the respective product pages. The images published are purely illustrative: the Products may present slight differences compared to the photographs, linked to light conditions, monitor configuration, natural wear or other elements that do not alter the essential characteristics of the good. The User accepts this eventuality at the time of purchase.

4. Purchase methods and conclusion of the contract
The purchase of Products is permitted only to Users of legal age. The sending of the order by the User constitutes a contractual purchase proposal. The contract is considered perfected only when the Owner sends the order confirmation to the User's email address. The Owner reserves the unquestionable right to refuse orders, for example in the event of anomalies, suspected fraud, lack of availability, or obvious pricing errors.

5. Prices and availability
The prices indicated on the Site are expressed in Euros and can be converted into other currencies for information purposes. The price includes VAT where applicable, unless otherwise indicated. The Owner reserves the right to change prices at any time, without affecting orders already confirmed. In the event of an obvious material error in the published price, the order may be cancelled and the customer refunded.

6. Payments
Payment can be made using the methods available at the time of completing the order. The Owner is not responsible for any disruptions or refusals of authorization attributable to such suppliers. Payment data is never processed or stored by the Owner.

7. Delivery of Products
The purchased Products will be delivered to the address indicated by the User. Delivery times are indicative and not binding. In the event of delays attributable to the courier or to causes of force majeure, the Owner will not be responsible. Upon delivery, the User must verify the integrity of the packaging and the Product. In the event of obvious tampering, the package can be refused.

8. Right of withdrawal and returns
The right of withdrawal is regulated by current legislation. For details and updated procedures, the User is invited to consult the page dedicated to the Return Policy accessible here or from the footer of the Site. This document is an integral part of these Conditions.

9. Service for sales by the user
The Site allows the User to propose the sale of used luxury bags to the Owner through a specific procedure described in the dedicated section accessible here . Sending images or information relating to the bag does not constitute an obligation for the Owner to proceed with the purchase. The Owner reserves the unquestionable right to accept or reject the proposals received. If the bag is accepted and sent, it will be subjected to verification of authenticity and correspondence with what was declared. In the event of non-compliance or lack of authenticity, the bag may be returned to the User, with the costs borne by the same. Any payment will be made only following a positive verification.

10. Third party services and external links
The Site may contain links to third-party websites or integrate optional tools provided by third parties. Such tools and links are provided "as is" and "as available", without any guarantee by the Owner. The User uses such tools at his own risk and discretion. The Owner is not responsible for third-party content, products or services, nor for damages resulting from any interactions with such parties. The User is invited to consult the conditions of use of such tools or sites before proceeding with any operation.

11. Content submitted by users
If the User voluntarily sends comments, suggestions, images, proposals or other content, via email, form or social media, the Owner may use them freely and without obligation to pay. Such content will not be considered confidential. The User is solely responsible for what is sent and guarantees not to violate the rights of third parties. The Owner reserves the right to remove content deemed inappropriate, offensive or not compliant with these Conditions.

12. Legal guarantee of conformity
Pursuant to the Consumer Code, the Owner guarantees that the Products sold are compliant with the contract. In the event of lack of conformity, the User has the right to have the goods restored to conformity, replaced or reduced in price, as provided by law. To exercise the rights, it is necessary to contact the Owner within the terms provided.

13. Limitations of liability
The Owner will not be liable for damages resulting from improper use of the Site or the Products, nor for indirect or consequential damages or loss of business opportunity. The Owner cannot be held liable for disruptions attributable to third parties, network malfunctions, or force majeure.

14. Intellectual Property Rights
All content on the Site (texts, logos, images, graphics, etc.) is the exclusive property of the Owner or used under license. Reproduction, distribution, publication or use for purposes other than consultation of the Site is prohibited, unless authorized in writing.

15. Applicable law and competent court
These Conditions are governed by Italian law. For any dispute arising from or connected to the use of the Site or the sale of the Products, if the User is a Consumer, the competent court is that of his/her place of residence or domicile, unless otherwise provided for by mandatory provisions. For all other cases, the competent court is that of Turin.
